Under the Agreement on Technical Barriers to Trade (TBT Agreement), WTO members are required to report to the WTO all proposed technical regulations that may affect trade with other members. The WTO Secretariat circulates this information to all member countries in the form of “notifications”. Effective June 21, 2021, the Government of Canada has imposed new sanctions on 17 individuals and 5 entities pursuant to the Special Economic Measures (Belarus) Regulations (“Regulations”). The sanctions were imposed in response to alleged systematic human rights violations and the change by the Belarusian regime on 23 May 2021 of Ryanair Flight 4978 from its original route to Minsk. The Government of Canada is coordinating with the United Kingdom, the European Union and the United States to implement the sanctions.
Persons listed under the rules are considered ineligible to enter Canada under the Immigration and Refugee Protection Act. In addition, the Regulation effectively freezes the assets of listed individuals because, subject to certain exceptions, any person in Canada and any Canadian outside of Canada is prohibited from:
1. Dealing with any property owned, owned or controlled by or on behalf of a listed individual, wherever located;
4. Provide something, wherever located, to a person on the List or to a person acting on behalf of a person on the List; and
The rules also prohibit any person in Canada and any Canadian outside of Canada from knowingly engaging in any act that causes, facilitates or assists or is intended to cause, facilitate or facilitate any of the prohibited acts described above.
